Terms and Conditions

  1. Information on how to enter and the prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. The promoter is FSS Trustee Corporation (ABN 11 118 202 672) of Level 21, 83 Clarence Street, Sydney NSW 2000, telephone 1300 650 873 (“Promoter”).

  3. Entry is only open to Australian residents aged 14 years and 9 months or over. Entrants under 18 years of age must have parent/guardian approval to enter. Parents/guardians may, on request from the Promoter, be required to provide written proof of consent to the minor participating in this promotion. Any prize won by a minor will be awarded to their parent/guardian on the minor’s behalf.

  4. Employees of the Promoter (and their immediate families) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  5. Promotion starts at 9:00am AEDST on 22 April 2019 and final entries close at 5:00pm AEST on 30 June 2019 (“Promotional Period”).

  6. There are two (2) components to this promotion, component one (“Component 1”) open to individuals who already have a First State Super superannuation account as at 15th April 2019 (“Existing Members”) and component 2 (“Component 2”) open to individuals that successfully open a First State Super superannuation account between 15th April 2019 and 5:00pm AEST on 30th June 2019, excluding those referred in accordance with Component 1 (“New Members”). Income Streams (including transition to retirement and retirement income streams) are not included.

Component 1 - Existing Members

  1. Existing Members will receive a ‘Refer a Friend’ email, from the Promoter, inviting them to refer their friends and family to become a New Member. Each Refer a Friend email will include a unique refer a friend link (“Unique Entry Link”).

  2. To enter, Existing Members must share their Unique Entry Link with their friends and family (“Referred Friend”) and invite them to become a First State Super member and enter the promotion. The Referred Friend must click on the link from the Existing Member and follow the prompts to successfully open an eligible First State Super superannuation account during the Promotional Period.

  3. For every Referred Friend that subsequently opens a First State Super superannuation account and becomes a New Member via the Unique Entry Link during the Promotional Period, the Existing Member will receive one (1) entry into the draw for Component 1 and the Referred Friend will also be given a corresponding automatic entry into the draw for Component 1, to each be eligible to win a prize as detailed in clause 12 and 14 below. For clarity, Existing Members are eligible to earn multiple entries with one (1) entry awarded for each successful referral.

  4. Existing Members warrant that the individuals they refer the promotion to will be Australian residents aged 16 or over who consent to receiving such communications/referrals from the Existing Member.

  5. The draw for Component 1 will take place at Anisimoff Legal, Suite 5/210 Central Coast Highway, Erina NSW 2250 at 12:00pm (noon) AEST on 12th July 2019 in the presence of a scrutineer. The Promoter may draw additional reserve entries and record them in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing by email within two (2) business days of the draw and their name will be published in The Australian and online at www.firststatesuper.com.au/winners on 26th July 2019.

  6. The first valid entry drawn in the Component 1 draw will win $10,000 (awarded in the form of a Visa Debit Card) as well as a $10,000 donation (“Donation”) to be awarded to a registered charity, school or community group of their choice on their behalf (together the “Prize”). The corresponding Existing Member or Referred Friend shown on the drawn entry will also be awarded a Prize.

  7. The Donation will be made to each winners selected registered charity, school or community group on their behalf and in a lump sum. The Promoter will liaise with each winner, at the time of winner notification, to determine their selected registered charity, school or community group, in the event that agreement cannot be reached, the Promoter reserves the right to determine the selected registered charity, school or community group. Winners may refer to the following list https://www.acnc.gov.au/charity in order to help determine a selected registered charity, school or community group. Political and/or religious charities are not permitted.

  8. The next one thousand (1,000) valid entries drawn in the Component 1 draw will each win a $100 prepaid Visa Debit Card (“Minor Prize”). The corresponding Existing Member or Referred Friend shown on each of the one thousand (1,000) valid entries drawn will also be awarded a Minor Prize. In the event any winners of a Minor Prize are residents of ACT, their name will be announced online at www.firststatesuper.com.au/winners.

New Members - Component 2

  1. Excluding any New Members that become a New Member via a referral as part of Component 1, any individual that becomes a New Member and opens a First State Super superannuation account during the Promotional Period will be awarded one (1) automatic entry into the draw for Component 2. Entry into Component 2 includes individuals who open an account personally, as well as those who open an account via their employer.

  2. Individuals who open a First State Superannuation account via their employer will only be deemed valid for entry into this promotion (and the Component 2 draw) if (a) their employer has processed their Superannuation Guarantee to the Promoter; or (b) they make a voluntary contribution to their newly opened First State Superannuation account; or (c) they consolidate an external super fund into their newly opened First State Super account during the Promotional Period. If the individual’s Superannuation Guarantee does not get processed during the Promotional Period, or they have not made a voluntary contribution or completed an external superfund consolidation, the individual will not be entitled to an entry into the Component 2 draw.

  3. The draw for Component 2 will take place at Anisimoff Legal, Suite 5/210 Central Coast Highway, Erina NSW 2250 at 12:00pm (noon) AEST on 12th July 2019 in the presence of a scrutineer. The Promoter may draw additional reserve entries and record them in case an invalid entry or ineligible entrant is drawn. General

  1. Any ancillary costs associated with redeeming the Visa Debit Card are not included. Any unused balance of the Visa Debit Card will not be awarded as cash. Redemption of the Visa Debit Card is subject to any terms and conditions of the issuer including those specified on the Visa Debit Card.

  2. As a condition of accepting a Prize, winners must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  3. Entrants must still have an active superannuation account with First State Super if drawn as a winner, to be deemed valid and receive a Prize/Minor Prize.

  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence and the status of their super account with the Promoter) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process including but not limited to tampering by way of use of techniques designed to engage in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  5. Incomplete or indecipherable entries will be deemed invalid.

  6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  7. The Promoter’s decision is final and no correspondence will be entered into.

  8. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a Prize/Minor Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize/Minor Prize (or that element of the Prize) will be forfeited.

  9. If a Prize/Minor Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize/Minor Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  10. Total prize pool value is $260,000.

  11. Prizes/Minor Prizes, or any unused portion of a Prize/Minor Prize, are not transferable or exchangeable and cannot be taken as cash.

  12. A draw for any Prize/Minor Prize if unclaimed may take place on 8th October 2019 at the same time and place as the original draws, subject to any directions from a regulatory authority. Existing Members and Referred Friend entries will be treated independently for the purpose of the unclaimed prize draw and in the event only one party from a drawn Component 1 entry claims their prize, only the relevant unclaimed prize (per clause 12 or 14 above) will be re-awarded in the unclaimed prize draw.  Winners (if any) will be notified in writing by email within two (2) business days of the unclaimed prize draw and their names will be published in The Australian and online at www.firststatesuper.com.au/winners on 22nd October 2019.

  13. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  15. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  16. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize/Minor Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize/Minor Prizevalue to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use or redemption of a Prize/Minor Prize.

  17. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at firststatesuper.com.au/privacy. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside Australia.
